The Election Commission has slapped a notice on Gujarat Congress President Arjun Mothwadia for violating the Model Code of Conduct for his monkey remark against state Chief Minister Narendra Modi and for raking up his personal life.
The Commission in its meeting chaired by Chief Election Commissioner V S Sampath decided to issue the notice to Mothwadia to show cause why action should not be taken against him for violation of Model Code.
BJP MP and state unit general secretary Balkrishna Shukla had filed a complaint with the EC about Mothwadia's speech.
The EC has asked him to reply in writing by 5 PM on November 24 on the notice, failing which action will be initiated without any further reference.
The Model Code says "criticism of other political parties and candidates, when made, shall be confined to their policies and programme, past record and work. Parties and candidates shall refrain from criticism of all aspects of private life, not connected with the public activities of the leaders or workers of other parties."
The Commission has considered the matter and is of the view that Mothwadia's statement prima facie constitutes violation of the Model Code which prohibits personal attacks on the leaders of rival political parties and criticism of all aspects of their private life, the notice said.
At a public meeting in Vadodara on November 2, 2012, Mothwadia had said, "Every morning he
(Modi) asks Dr Manmohan Singh, come and fight elections against me...Just as a monkey climbs and tree and sitting up on that tree asks the lion standing down on the ground to come up, come up..."
He had also said, "Every day he repeats Dr Manmohan Singh ...Manubhai is sitting here...He is infected with rabies...
Manubhai, he has been bitten by rabid dog..."
Besides, he had also raked up Modi's personal life by stating, "Chief Minister, within your life what about your married life? Gujarat knows it. Why don't you disclose it one day? And why it didn't work out after marrying..."
Besides Shukla's complaint, the Commission had also received reports of Chief Electoral Officer and District Election Officer stating that Modhwadia has violated the Model Code by making objectionable remarks against Modi while campaigning in Vadodara on November 2.
Before issuing the notice, the Commission had obtained the CD of his speech and also its transcript.
"The Commission hereby gives notice to you to show cause as to why action should not be taken against you" for the Model Code violation, the notice said.
"Your written reply, if any, should reach the Commission latest by 5 PM on 24th November 2012, failing which it would be assumed that you have nothing to say in the matter and appropriate action will be taken against you without any further reference to you."
The Model Code also says criticism of other parties or their workers based on unverified allegations or distortion shall be avoided.
