Madhya Pradesh High Court today dismissed a habeas corpus petition for production in the court social activist Medha
Patkar, who was arrested in Chhindwara.
The division bench of Justices K K Lahoti and Vimla Jain said the petition was baseless, as the Chief Judicial Magistrate's court at Chhindwara had already released her.
However, the court said that petitioner Anurag Modi of Samajwadi Jan Parishad may file a separate petition against the alleged illegal manner of the arrest.
Patkar was arrested by the police two days ago at Chhindwara, when she arrived there to protest against Pench River Project, on the charge of unlawful assembly and violation of orders restricting entry in the area.
But Modi claimed in his petition that she was arrested from the house of advocate Aradhna
Bhargava. Patkar had called on Bhargava to condole the death of her mother, he said.
The government lawyer said Patkar was arrested in view of the prevailing situation in the town. The arrest was necessary to maintain law and order, the lawyer added.
