SIT Resisting Evidence Against Cops: 2002 Victims
Victims and witnesses of the 2002 Gulberg Society massacre alleged today in an affidavit before the Gujarat High Court that the special investigation team has been resisting evidence against police officers to be brought on record, and expressed suspicions about the SIT's motives.

Sairaben Sandhi, a victim and one of Gulberg Society massacre's prime witnesses, today filed an affidavit in the Gujarat High Court opposing the SIT's petition challenging the trial court order.

The SIT had sought a direction from the high court to restrain the trial court taking cognisance of all reports and documents related to further investigation related to some senior police officers whom the victims have demanded to be arraigned as accused in the Gulberg Society case.

Judge B J Dhandha had directed the SIT to produce relevant reports and documents pertaining to alleged criminal negligence of former Joint Commissioner of Police M K Tandon and former DCP P B Gondia from the final report it had filed in the magisterial court, related to Zakia Jafri's complaint.

Sandhi also alleged that though the SIT never objected to these documents being brought on record until May 23, all of a sudden, it filed an application praying for reports and documents already submitted before court, to be not taken into cognisance.

Though the designated court has refused to review its previous order, it has agreed not to take cognisance of the reports and documents, until the SIT gets a clear order from the Gujarat High Court.

The Gujarat High Court will now hear the case on November 6.

Several eye-witnesses and even police witnesses had deposed exposing the criminally negligent role of both Tandon and Gondia and other officers. Thereafter in January 2012, victim witnesses had filed an application under section 319 praying that they be arraigned as accused. Documentary evidence that had come ion record (again through an application filed by victim witnesses and an order of the special court on 7.9.2009) that showed the police control room records etc has also pointed to errant and criminally negligent behavior by these policemen.......Partially allowing the application at that stage, the Judge had kept any decision on the two police officers pending because at that stage the SIT itself had argued that the ongoing investigation in the Zakia Jafri case had still to be completed and that these officers were being investigated in that complaint. Investigating Officer in the Zakia Jafri complaint Shri AK Malhotra had in his report filed before the Supreme Court mentioned that investigations against Tandon and Gondia were still on.

So SIT investigation is still on! This is what Ashish Khetan, who conducted the crucial Tehelka Sting has to say about SIT investigation--

In March 2008, the Supreme Court constituted a Special Investigations Team (SIT), headed by retired CBI director RK Raghavan, to re-investigate nine major riot cases, including the Godhra train burning, Gulberg Society and Naroda Patiya massacres.

I wrote to the SIT and asked to depose before it. Soon, I received a communiqué from Raghavan’s camp office and I was told to appear before him. I appeared before the full panel of SIT, which at the time included Geeta Johri, Shivanand Jha and Ashish Bhatia — all Gujarat cadre IPS officers. I submitted the full raw footage and the transcripts. I made a passionate plea in my meeting with Raghavan. “If I, as an individual reporter, with no powers other than that of a common citizen, can gather so much evidence and peel off so many layers of judicial subversion and miscarriage of justice, I’m sure that your team with full statutory powers and the mandate given by the Supreme Court can get to the bottom of 2002 riots,” I told Raghavan. All along, the SIT members kept a straight face and didn’t say much.

I didn’t know at the time that what lay ahead was a tortuous journey for the victims and the witnesses. As time went by, the much-hyped SIT only turned out to be a sophisticated version of the Gujarat police — but only slightly. www.tehelka.com/story_main53.asp

Saroja has spoken the truth,the way critical evidence has been destroyed.

The SIT must accept complaints  and investigate the Cops Named by the victims.

Documents are either too routine that they can be destroyed or so sensitive that they can not be revealed. This farce of SIT has gone on for too long. It is acting more as a defence team for the accused,

The so-called SIT has to protect police officers because if the police officers are criminally charged, one or more of them may turn state witnesses and testify against Modi.
