Police Seek HC Nod for Narco-Test on Ghandy
Delhi Police today told a court here that arrested naxal leader Kobad Ghandy had a link with Maoists in Nepal and sought its permission to conduct narco-analysis test on him, claiming they could not extract "all useful" information from him despite using all scientific methods during interrogation.
"During investigation, a number of CDs, including one showing Ghandy being greeted and cheered by armed supporters of the Communist Party of Nepal, had been recovered," Public Prosecutor Naveen Kumar told Chief Metropolitan Magistrate Kaveri Baweja.
He said Ghandy was a politbureau member of CPI(Maoists) the banned outfit which wanted to establish a red corridor in association with Maoists in Nepal.
In the plea for narco-analysis test on Ghandy, the police claimed that "despite using all scientific methods of interrogation and efforts, the accused did not give full co-operation and did not disclose all useful information."
They again referred to the killing of Jharkhand police Inspector Francis Induwar, who was beheaded after being abducted, to claim that Ghandy had a strong link with Maoists because he, along with Chhatradhar Mahato and another leader, was sought to be released in exchange for the safety of Induwar.
Ghandy's counsel Rebecca M John denied all the charges claiming the police could not prove if the CDs showing the accused being hailed was related to the events which took place after the Centre banned CPI(Maoists) on June 22 this year.
CMM Baweja reserved the order on the bail plea and put the application for narco-analysis for arguments for tomorrow.
During the arguments on bail, public prosecutor Kumar referred to a CD allegedly recovered at the instance of Ghandy claiming that it showed Maoists planning to carry out attacks in Magadh division.
He said the investigation was still at the initial stage and the process to collect evidence would be hampered with the release of the accused on bail.
The police, which also moved the application seeking to conduct narco-analysis test of Ghandy, claimed "the accused is a main leader of the outfit and have a thorough knowledge and information which is very important to unearth the conspiracy of unlawful activities."
Ghandy, who was arrested from the national capital last month, has been remanded to 14 days judicial custody on October 15.
He has been booked under various offences under the Unlawful Activities (Prevention) Act.
