No truth in allegations against us, Lodha camp tells SC
New Delhi, Aug 29 (PTI) The Lodha camp today sought quashing of a criminal complaint filed against it by the Birla Group in the Priyamvada Birla will case, as it argued before the Supreme Court that there was absolutely no truth in the allegations.

Senior advocate Harish Salve, appearing for the Lodha camp before a bench comprising Justice B P Singh and Justice S H Kapadia, asserted that there was no breach of trust by the Lodhas as alleged in the complaint.

During the five-hour long inconclusive arguments, the counsel appearing for Shiva Nath Prasad, who has been cited as one of the accused in the complaint, said it was was filed at the behest of the Birla Group by one of their employees as the the Birlas want to control the whole empire.

Prasad has filed the Special Leave Petition (SLP), challenging a Calcutta High Court order, which dismissed his earlier plea for quashing the complaint filed by the Birla group employee Rajendra Prasad Pansari.

Salve forwarded elaborate arguments as to how the complaint was baseless even if one took a prima facie view.

Prasad, who along with R S Lodha, V Gauri Shanker and Sushil Kumar Daga were made accused in the case filed by Pansari, challenged the July 1 order of the high court.

Pansari, working with the M P Birla group since 1977, had filed a complaint before an Alipore Court in Kolkata that after the death of Priyamvada Devi Birla in July 2004, it was found by him that "Lodha had criminally conspired with the other accused and misappropriated properties worth Rs 2,400 crores vested in five trusts" meant for charitable purposes.

The petition filed through advocate Ankur Chawla stated that the criminal complaint against Lodha should be quashed as it had been filed by a person, who has no interest in estate and properties.
